Effective January 2008, New Jersey has stiffened the Graves Act, affecting virtually anyone caught carrying a firearm without a permit. Even if an individual legitimately owns a handgun but carries it unlawfully (without a gun permit), they are violating a regulatory provision and are subject to harsh penalties — a minimum of 3 years in New Jersey state prison.
